The 1099 year-end tax forms (such as 1099-MISC and 1099-K or form 1042-S) sent to you by YouTube contain your tax information such as your TIN, the payments you received in royalties, amount of payments you accepted via payment cards or received via third party networks, and your federal income tax withheld, depending upon the type of 1099 form that applies to you.

If you are a monetizing creator on YouTube under the YouTube Partner Program (YPP), you are required to provide your tax information to Google. This is because Google is mandated under Chapter 3 of the Internal Revenue Code to collect tax information, withhold taxes, and report to the IRS.

If you fail to share your tax information, Google will withhold taxes at the maximum rate of 24% of your total income worldwide. Therefore, irrespective of your location as a creator, you must ensure that you share valid tax info with Google to avoid taxes being withheld from your income at maximum rates.

What Is YouTube 1099 Form?

The 1099 form is a series of tax forms that are typically filed by businesses or individuals to the IRS who make payments during the year as part of their business or trade. Businesses or individuals making payments during the year as part of their trade or business file information returns to the IRS via a series of 1099 forms such as 1099-MISC, 1099-K, etc.

Since Google as a business makes payments in various ways to the monetizing YouTube creators during the year, it must file information returns to the IRS via a series of 1099 forms. Google is mandated under Chapter 3 of the U.S. Internal Revenue Code to collect tax information from all its monetizing creators regardless of their location, withhold taxes on any YouTube earnings of creators from viewers in the U.S., and report such earnings to the IRS, the U.S. tax authority.

You may earn income from the viewers in the U.S. in the form of ad views, YouTube Premium, Super Chat, Super Stickers, and Channel Memberships.

Therefore, if you are a monetizing creator under the YPP, you must fill out your W9 form accurately to provide your tax information to Google if you are a US-based creator. This is to avoid being taxed at the maximum tax rates by Google on your earnings worldwide. U.S. tax law requires Google to withhold taxes from your earnings from U.S. viewers. The withholding tax rates and requirements vary based on your country of residence. Further, if there is any change in the mailing address or contact information, make sure you update the same in your W9 form.

How Do I Get My 1099 From YouTube?

I. If You Are A US Creator

If you have provided accurate tax information in your W9 form, Google will not withhold any taxes on your earrings. You can access your YouTube 1099 form by logging into your Google AdSense account. See the step-by-step process of accessing your YouTube 1099 form in the section below.

In case you do not provide valid tax information within time, Google will be required to withhold taxes on your earnings as follows:

a. In Case, You Are A Business In The US

Businesses in the US are subject to a 24% withholding tax on their total earnings worldwide

b. In Case, You Are An Individual In The US

Individuals, too, will be subject to a 24% withholding tax on their worldwide earnings.

II. If You Are A Creator Outside The US

Creators outside the US are subject to a withholding tax between 0-30% on their earnings from US viewers if they submit valid tax information to Google within the stipulated period. They are also eligible for a tax treaty benefit if such a treaty exists between the US and their country of residence. Therefore, it is important to provide accurate tax information to Google via the W-8BEN form in the case of individuals and the W-8BEN-E form in the case of businesses.

What Is A Tax Treaty Benefit?

The US has tax treaties with a host of countries in the world. These tax treaties with foreign countries allow the residents of the foreign countries to be taxed at reduced rates, and in some cases, exempt the residents of foreign countries from being taxed on their earnings from sources within the US.

You can check out the tax treaties page of the IRS to see if the US has a tax treaty with your country of residence and claim the tax treaty benefit if applicable. Thus, submitting valid tax information to Google within time can make you eligible for claiming a tax treaty benefit and reduce the withholding tax on your earnings from the US viewers. (only if there exists a tax treaty between your country of residence and the US).

In case you do not provide valid tax information within time, Google will be required to withhold taxes on your earnings as follows:

(i) In Case, You Are a Business outside the US

Businesses outside the US are subject to a 30% withholding tax on their total earnings worldwide

(ii) In Case, You Are an Individual in the US

Individuals, on the other hand, will be subject to a 24% withholding tax on their worldwide earnings.

Further, you will also be able to access your tax reporting documents on the same page under the ‘Tax Reporting’ section, with the date of the document issued as well as the tax document, which you can download and use for filing your tax returns as a creator.

1. 1099-MISC

1099-MISC is a tax return that is required to be filed by businesses and individuals who make certain types of payments to persons during the year as part of their trade or business. These include a minimum of $10 in royalties or broker payments in lieu of dividends or tax-exempt interest, or at least $600 in rent, rewards, and prizes, other incomes, etc.

Since YouTube pays royalties to artists and income from ad views, many creators falling in this category may receive a 1099-MISC form from YouTube. YouTube may file a 1099-MISC and send a copy of the same to you.

2. 1099-K

1099-K is a tax return that is required to be filed by payment card companies and third-party payment networks like payment apps or online marketplaces with the IRS if the gross payment amount (paid to the taxpayers) is more than $600. Accordingly, Google being a business needs to file form 1099-K to the IRS for creators who accept payment cards on YouTube for paid channel memberships, Super Stickers, and Super Chats and send a copy of the form to these creators by January 31.

Therefore, if you are a monetizing YouTube creator accepting payment cards for your channel’s paid memberships or for receiving money for Super Chats and Super Stickers, you will receive YouTube 1099-K from Google.

This form reports your tax information such as TIN, personal details such as your name and address, and payment information such as the Gross Amount of Payment Card/Third-Party Network Transactions, number of payment transactions, federal income tax withheld, etc. You as a creator can download this form from your Google AdSense account and use the payment information in your 1099-K form to file your income tax returns.

3. 1042-S

1042-S is sent to a non-US resident who has US source income that is subject to withholding tax. Accordingly, if you are a creator based outside the US, you may receive the 1042-S form in your Google AdSense account.

This tax form contains your tax information such as foreign tax identification number, account number, tax rate, federal tax withheld, etc.

You can simply download your 1042-S from YouTube and use the information contained in this tax form for tax filing purposes in your country.
